The Colorado Noise Statute and the Jefferson County Noise Abatement Regulations are almost identical. Both are clear, well written and unambiguous. They declare noise in excess of the allowable levels as a "public nuisance". "Quiet Time" in Colorado and Jefferson County starts at 7:00pm as shown in the regulations. The regulations recognize that steady state noise is less obtrusive than "periodic, impulsive or shrill noises" by setting the allowable noise level 5dB(A) lower than the listed levels.



Jefferson County: 5.90 Noise Abatement

5.90.1 Declaration of Policy: It is hereby declared to be the policy of the County of Jefferson that the peace, health, safety and welfare of its citizens require protection from excessive, unnecessary and unreasonable noise. It is the intention of this regulation to control the adverse effect of such noise sounds. (CC88-553)

5.90.3.1 No person shall operate any type of vehicle, machine, or device, or carry on ANY activity, or promote or facilitate the carrying on of ANY activity which makes sound in excess of the level specified in 5.90.5 of this Regulation. (CC88-553)

5.90.5.3 Sound from a non-vehicular source located in a residential zone, shall not exceed the following limits: (CC88-553)
  • 7:00 A.M. until 7:00 P.M. 55 dB(A)
  • 7:00 P.M. until 7:00 A.M. 50 dB(A)
5.90.5.4 Periodic, impulsive, or shrill noises are hereby declared unlawful when such noises are at or above a sound level of five dB(A) less than those listed in Section 5.90.5.1, 5.90.5.2, 5.90.5.3, or 5.90.5.5 of this Regulation. (CC88-553)

5.90.4.3 Sound from a non-vehicular source shall be measured twenty-five feet from a property line. (CC88-553; CC92-692; BCC Minutes dated 4/20/93)

5.90.10 Violations, Penalty. Any person who violates any of the provisions of this Regulation commits a Class 2 Petty Offense. (CC88-553)
  • All charges and proceeding relating to any violation of this Regulation may be cited for compliance with the penalty assessment procedures pursuant to Section 16-2-201, C.R.S., and as set forth herein. All persons who acknowledge guilt or are found guilty shall be punishable by a fine of $30.00 for each separate offense, plus customary court costs when applicable. A graduated fine schedule is to apply: a $30.00 increase for each recurring offense, beginning at $30.00 to a maximum of $300.00. (CC88-553)
