Donna and Jeff Mercer agree that children will not play in their backyard play area (see NOTE 1) after 6:30pm on weekdays. They also agree that their children will not play in their backyard play area on Sunday.

Larry Potter agrees that children may play in the Mercers backyard play area any time on Saturday. Larry also agrees to adjust the security camera on the west side of his home so that it no longer looks into the Mercers yard. When toys go into the Potter's yard, the Mercers will call Larry to return them.

In the future both parties agree to talk about issues as they arise.

The parties agree that children and other family members will not climb on the fence.

The Mercers also agree to restrict their children from excessive screaming.

They will also ask their children to respect Larry's privacy by not peering into his yard with the intent of seeing what Larry is doing and commenting on his activities.

(The Mercers must have had their "fingers crossed" under the table as they signed the contract, since it only took them 34 days to start violating the mediated agreement)



Due to their constant cheating on the existing agreement, I unilaterally offered to Jeff to extend the weekday playground time from 6:30 to 7:00 pm, in exchange for them actually honoring the times. (See NOTE 2)


NOTE 1:
The Mercers constantly tell people, the police, the mediators and the courts that the agreement requires that their children are required to be INSIDE after 6:30 (v1) and 7:00pm (v2). The children were to be out of the playground area only, there were no other restrictions on their location or activities. By incorrectly describing the agreement details, they make people believe it was too restrictive to gain false support.
NOTE 2:
The Mercers agreed to the change, and then started cheating again on the newly revised agreement. See The Cheating Chronicles.
NOTE 3:
I unofficially agreed to allow the Mercers to put up their ugly green cover back up over the slide tower (HOA rule) - in exchage for them making his agreement. When they refused to even pretend to honor the agreemnt in 2004, they of course kept the green cover in place. No honor, no integrity, no trust, the list is endless...
