What is your problem?

Excessive and Illegal Noise: The noise coming into my home and backyard from the Mercers playground is loud, too loud, and has been measured well over the legal limits. It's not that I hear children playing, it's the high-pitched ear-piercing, bone-jarring, blood-curdling, spine-tingling
screaming and screeching at excessive and illegal levels that I can't accept.
Privacy: The Mercers put a HUGE eye-sore playground - swingset structure with slide platform right up against our property line. That gets it " out of their way" and right into mine. The slide platform (watch) tower faces directly into my back yard giving their children and guests a clear view into my yard at any time of their choosing. There is a 6' fence, but their slide platform towers over it. I have a hard time calling it a "privacy fence" anymore...

I can't use my back yard when their swarm of children are out screaming and shrieking and staring, and I never know when they will be out screaming and shrieking and staring, so I never know when I can use my property.

To be able to use my backyard at times of my choosing without the Mercers excessive and illegal noise destroying my Right to Life, Liberty and the Pursuit of Happiness.

Why did you buy a home in the suburbs?
|
Where else is there to buy? My choices are apartments or condos or the suburbs. Finding property with land is beyond my financial means, nor would I be willing to endure the long commute to the office.
Colorado is very different from many parts of the country. With all the open space we have, the housing areas are jammed together with smaller lots than other states with higher population density. My lot is actually large by "Denver Standards".
The city and county governments want to preserve "open space" for the citizens, so they take HUGE parcels of land for public parks. This of course means there is less and less land for homes and yards. We have a HUGE public park right by my neighborhood. But do the Mercers take their children to the park to scream? Nope, they send them out to their personal playground, jammed between our houses, just 8' from my home to scream. The Mercers don't want the eyesore play equipment cluttering up their small backyard, so it's jammed in right between our houses up against my property line, out of their way, and right in mine. So much for the city planners....

Do you hate children?
|
No.
Whether I like, dislike or hate children is irrelevant to the dispute. The noise from the Mercers playground has been measured at illegal levels, which proves it's too loud, not my opinion, but a cold hard measured fact.
Selfish Takers hate facts, they hate measurements, they hate reality. They do like inciting hate and discontent by attacking my character with lies and distortions and ignoring the facts.

Do you dislike children?
|
Some. I dislike loud and undisciplined and unruly children. I dislike their parents even more for not teaching the children better. I do worry that these loud and undisciplined and unruly children will grow up into adults that are the same or worse than their parents.
Children are quite smart. The Mercer children see that when their parents don't get to abuse their neighbor, they resort to and condone illegal harassment activities against me. So when one of these children has a problem in school, how do you think they will react? What have they learned?
Who were their role models? Donna and Jeff Mercer? Woody747?
Honesty and Integrity has not been the rule of the day at their home. See what I mean? Scary, isn't it?

Are these children unusually loud?
|
Unfortunately yes...
This is not just some slightly loud children, they are unusually loud and the playground is just 8' from my home. Unusually loud children and they are unusually close to my home and backyard. Their high-pitched screams and squeals are ear-piercing, bone-jarring, blood-curdling and spine-tingling.
Unpleasant to say the least... More than one guest at my home has become alarmed at some of the sounds, thinking a child was mortally wounded from the unsafe playground by the shrillness and intensity and volume of the sound in my backyard and inside my home. I've measured the screaming and shrieking at illegal levels using a sound pressure level (SPL) meter, trust me, it's beyond reasonable. But their playground is " out of their way"...
Let's put this all in perspective. The Mercers were aware one of their daughters has a " SCREAMING PROBLEM". The Mercers were concerned about the playground noise before I moved in and even warned me about it before they even started their landscaping. But they put the playground in their side yard anyway, just 8' from my home and jammed up against my property line.
To hell with anyone else, as long as the playground is "out of their way".
The Mercers' are truly the Toxic Neighbors From Hell we all fear.

Why do you keep this website updated?

The Mercers continue to pollute my air space with high-pitched, blood-curdling and spine-tingling screaming and shrieking at any hour of the day or night. They've been out screaming and shrieking until 8:40 this year (2005).
And now they have started doing the same screaming and shrieking directly in front of my house on the sidewalk. Their 5+ children are all unusually loud, Jeff Mercer has even admitted in 2000 and confirmed again in 2004 that one of his daughters has a "screaming problem". Personally I think they all have screaming problems, the rest just seem to follow her lead....
I honestly believe that Jeff and Donna Mercer send the children out to scream and shriek when I'm outside or have just arrived home. They have access to the west side of my property (playground side) and the south side (street side) and those two locations are where the swarm of children seem to like to play and scream and shriek the most - which is just way too much of a coincidence, I don't believe in coincidences.
The parents claim they and their children are "afraid" of me, yet they encourage them to do what annoys me the most at the closest locations to my home that they can get. Their claimed "fear" is all acting, watch them them choose to keep the trampoline " out of their way" over keeping a restraining order in place. The Mercers could choose to share, or they could choose to raise the tension level by using their children as Weapons of Mass "Peace and Quiet" Destruction, they choose the latter.
Maintaining this website keeps the public informed of the atrocities and war crimes the Mercers are committing against society, and provides me with stress relief.
The Mercers' are truly the Toxic Neighbors From Hell we all fear.

Being single, are you more sensitive to noise than the parents in your neighborhood?
|
Maybe. And that is why we have noise abatement laws with clear cut guidelines and measurement techniques to determine what is and what is not too loud.
It is not my "opinion" that the screaming noise from my neighbors playground is too loud, it's a scientifically measured fact. The noise has been measured 11-23 db over the legal limits following the exact procedures outlined in the noise abatement law.

The Jefferson County Sheriff's Department has not refuted my measurements, they cowardly refuse to enforce the law. I thought that's what police were for, to enforce the law, to " Protect and Serve".

Yes.
A Jefferson County Commissioner " embroiled in scandal" recently (02-28-2005) resigned over allegations that HE was personally harassing a citizen who is an outspoken critic of Jefferson County Government.
Instead of protecting my rights as a taxpayer and citizen of Jefferson County, they are ignoring THEIR Noise Abatement laws and ignoring THEIR Harassment laws and ignoring THEIR theft laws.
Jeffco government has refused to prosecute violations of THEIR laws by those that have chosen to steal, threaten and harass me and invade my property with illegal noise levels.
We cannot trust the Jefferson County government to enforce and prosecute THEIR laws in a fair and equal manner. Once trust is betrayed, once they act in an arbitrary manner or for their own personal interests we citizens have no idea what to expect from them.

"They" spend their time making accusations to avoid having to discuss the facts.
None are true, but even if they were true, it still wouldn't change the noise levels their screaming and shrieking children make that leaks into my home and backyard.
Think about what you hear from them. They don't refute my measurements, they ignore them. They refuse to discuss the facts. Those that choose to mislead, hate the facts.
And then they make personal attacks against me and then HIDE BEHIND THEIR CHILDREN.
Compare my response to the neighborhood dispute verse "their" response and then consider the source when listening to the Mercers accusations against me.

Yes. They tell the police and the news media how worried they are about me harming their children to avoid discussing the facts. Yet, they continue to allow their children to scream and shriek at illegal levels just 8' from my home and back yard.
In fact, they seem to send out the screamers whenever I'm out in my backyard. No good parent that believed there was a threat would allow their children to take these (alleged) risks. There is no risk and they know it, but they use the natural concern of society for children as a weapon against me. It's predictable, it's low, it's underhanded, it's pathetic and it how Selfish Takers like the Mercers operate.
The police who investigated the dispute and the Mercers accusations had to conclude:
- "Jeff and Donna Mercer were not able to give me specific examples of a safety threat Larry had made or posed to their children".

I'll move when it's appropriate for me.
That's another method people like the Mercers use: America, Love It or Leave It.
I object to their illegal noise and abusive tactics and they tell ME to move.
Notice that nowhere on this website have I ever even suggested that THEY move. I've done nothing but try and find a way to share the airspace, the neighborhood. I try to share, they use abusive tactics in an attempt to force me to move.

That's another accusation and tactic used by the other side to avoid discussing the facts. If they can turn the attention to me, instead of them, maybe they can avoid anyone noticing just how wrong their position is. They are very good at this tactic.
Another distortion tactic is to attack me for having "too much free time". Anything to avoid the facts.
Jeff Mercer has complained that I update this website too often (???), but that he doesn't pay attention to it (???). For someone who claims to not be paying attention, Jeff sure spends lots of time whining to Channel 7 News and to KHOW talk radio ... about this website.

Why not just fight fire with fire?

Unlike the Mercers and their co-conspirators, I am an honorable person. I am willing to debate the problem on the facts. They despise the facts and will go to ever increasing levels of harassment and distortions to avoid the facts they fear. I will not sink to their level, else I'd be no better than they are.
"They" have literally used fire, there was an arson attempt at my home on 05-31-2004.

Eddie Haskell’s two trademarks are his politeness to adults and his weasly, sharp-tongued meanness to everybody else.
He is a model white-collar delinquent, a creep who goads people into trouble rather than perpetrating the crime himself. He was a born shirker, not worker, and a strain on any parent, especially his own long-suffering mother and father, who refer to him as an "over-stimulated adolescent"; but really, when it comes to Eddie, when you’ve said "creep", you’ve said it all...
Eddie Haskell is nothing short of an operator. He's all talk and attitude, in other words, a real creep. Eddie's the kind of guy that everyone sees through, except Eddie.
He's as oily in his politeness to adults as he is weaselly in his dealings with his peers.

They do right now.
There is a playground right behind me, up against the back property line fence. There is another playground right behind the Mercers near my backyard property line. I have never been annoyed from the child noise from these areas, in fact, I'm not really aware of them. These playgrounds are out in the open, where the sound dissipates in all directions.
The Mercers playground is jammed between our houses, up against the "privacy fence" and just 8' from my home. The screaming and shrieking sound has nowhere else to go, but to reflect off their tall 2 story home directly into my home and backyard.

I have never objected to hearing children playing, it's a normal sound of summer.
I object to hearing excessive noise well over the legal limits. That noise may be from children, or their parents, or from airplanes or an industrial complex or whatever. Loud and excessive and illegal noise is oppressive no matter what source it comes from.
If I made the same illegal noise level with my audio system, no one would be so tolerant. It's a form of discrimination for which I have yet to find a solution, but every single day it's an issue. Even on the rare days when the screamers do not come outside, I'm unable to plan any outdoor activities.
Any sound, sounds you may even find pleasant can become oppressive if it's too loud. There are limits to any sound level, as defined in the noise abatement law.

But they still have 5 children, how could the Mercers make things right?
|
First and foremost, they should move the playground to somewhere else in their yard that is not just 8' from my home. With the playground jammed up against my property line between our houses, it may be " out of their way", but its right in my way. They have many choices, but those choices would mean putting the playground where they may have to look at it, or hear it.
Another choice is to honor their word by honoring the Mediated Agreement we worked out and signed in 2001. Basically the agreement limited the playground hours. The children would not use the playground after 7:00pm on weekdays and all day Sunday. They could use the playground at any other time, making all the noise they want (illegal or not) and then give me some quiet time at the specified times. The agreement does not prohibit any other activity by the children or their location, it just kept them off the playground equipment.
The Mercers have spent considerable time telling everyone that the agreement meant that their children had to be INSIDE during the quiet hours to bolster public support. They've told this to the police and to a Judge and to mediators. Read the agreement, not true.

Why didn't the mediated agreement work?
|
Ask the Mercers. I honored my part at all times. The Mercers must have thought that having their fingers crossed when they signed the mediated agreement meant that it didn't count (like a 5 year old).
The Mercers started cheating on the mediated agreement in just 34 days after signing it. And continued to cheat for the next 3 years until they totally gave up even pretending to honor the agreement in 2004.

Why do you object to dogs running loose in your neighborhood?

Read the news. How many times do we read about someone's dog mauling or killing children or other animals in neighborhoods?
One of the loose dogs in my neighborhood has CHARGED me twice while I was riding my motorcycle as I approached my driveway. I managed to avoid a crash both times.
After having survived a bad motorcycle accident in 1999, and knowing what it's like to crash, and knowing what it's like to have my wrist shattered and painful skin grafts and months out of work, I prefer to keep off the ground. Must I wait for a dog induced crash to expect the animal control laws to be enforced?
When I was in my early 20's we were riding our bicycles through base housing in North Carolina. A huge dog came running out from a carport and CHARGED me hitting my front tire. Both the dog and I crashed to the ground. My bicycle was damaged and I had quite a bit of road rash. The dog owner was cited, I got a new bicycle, road rash and a bad memory about unpredictable loose dogs.
Or how about the time when I was 12 and bit by a large German Shepard while delivering newspapers? Whenever I or my parents would complain to the owner about the loose dog, we were told "he won't hurt you". I still have the scars on my leg...
