I received a call from a Jefferson County Sheriff Department Captain on 01-26-2005 inviting me to a meeting at the police station with him, the Investigator and the deputy that investigated the neighborhood dispute last summer.
We politely smiled and shook hands and then the Captain blamed me again for the harassment I've received ??? The Investigator told me there never was a "case" ( see below). I was not impressed. They now get to tell the Sheriff they had a "meeting". I was told again that there are thousands of people in the county and that Sheriff Mink will not meet with me.
I have made
attempts to meet with Sheriff Mink and he has refused. If there is any desire for resolution, it will require the direct attention of Sheriff Mink. I cannot believe, and don't want to believe that Sheriff Mink is involved in my "punishment" and the misinformation I'm being given from lower levels in his department.

Police protection and justice is not doled out equally and fairly in Jefferson County Colorado. It's arbitrary and it scares the hell out of me as it should every other citizen in Jefferson County Colorado. Today it's noise abatement and harassment and theft, tomorrow it could be something else involving any other citizen of the county, Will the police enforce the law? Who knows ???
There is a police force and District Attorney in Jefferson County Colorado. We citizens have no idea what the law is and what laws will be enforced and against whom they will be enforced. If there is a method to this madness, it eludes me.

I'm told the Sheriff and the District Attorney have "Prosecutorial Discretion".
Here is how I understand Colorado County Lawmaking. The Jefferson County Commissioners are elected officials. The Commissioners are the lawmakers, the law writers.
The Jefferson County Sheriff's Department can choose to be the law enforcers and the Jefferson County District Attorney can choose to prosecute violations of the laws enacted by the Jefferson County Commissioners.
Choose? Isn't the written Law the Law? No, both the police and the D.A. can choose which laws to enforce and whom to enforce them on using their "Prosecutorial Discretion".
In a perfect world (not Jefferson County) a police officer could stop someone for speeding and find out that the driver is a pregnant woman racing to the hospital to give birth. The officer would most likely not write a speeding ticket AND help her to the hospital.
In our not so perfect Jefferson County, the police and D.A. have chosen to ignore the very well written and clear Noise Abatement Laws as written by the Colorado Legislature and the Jefferson County Commissioners.
The law says I " REQUIRE" protection from excessive, unnecessary and unreasonable noise. The police and D.A. have refused me this protection.

5.90.1 Declaration of Policy: It is hereby declared to be the policy of the County of Jefferson that the peace, health, safety and welfare of its citizens REQUIRE PROTECTION from excessive, unnecessary and unreasonable noise.

The written law goes to great lengths to use the word ANY when describing the types of noise to which the law applies.

I was told again that the Jefferson County Noise Abatement law was not "intended" to be used against children. I again pointed out that I am expecting the law to be used against the parents. We went over the written law, where it says the citizens "REQUIRE PROTECTION" from excessive noise and how it says "ANY" noise or "ANY" activity that creates excessive noise... No matter, the written law does not matter.

I asked what the law was, if I can't know the law from reading the published law, would they tell me? They would not. I asked about what ages of people can make illegal noise, what times of day, quantities of screamers? No answer. I have no idea of what the law is. This is anarchy, we have police to enforce the "law", but they won't tell us what the law is. This is not the America I thought I lived in.

Jefferson County Sheriff's Department now claims "NO CASE"
During the summer and fall of 2004, many crimes were committed against me. I filed police reports on all of them.
Jeffco police take a report and any investigation that may be done is handled by the officer dispatched to take the report. This policy prevents connections from being made for linked crimes. Remember the Columbine failures?? There were many signs that a more serious crime was impending, but the Jefferson County Sheriff's Department was unable to link the smaller incidents into a pattern. There was a link between the crimes and I wanted them investigated together.
At my request, the case was assigned to an Investigator in the:

Part way through the summer, another Investigator was assigned.
I never saw any evidence that any investigation was being performed and I ended up investigating myself for my protection.
I was given a case number (04-15814) and I received emails from both investigators about the "case". On 02-01-2005 the Investigator told me there was "no case". After reviewing my notes and saved email messages from the Investigators, I am totally confused.
Draw your own conclusions, I have.
I believe the Jefferson County Sheriff's Department did virtually nothing to investigate any of these linked crimes. When I'd ask about their progress, they would say they were working on it, but they did virtually nothing. And now that I've attempted to obtain the police report on their "case" (which contains nothing), they are embarrassed, so they claim there was "no case".
Business as Usual: Little has changed in Jefferson County Colorado...

Read the raw excerpts from my notes below and excerpts of email messages I received from 2 investigators at the Jefferson County Sheriff's Office and decide if you believe that there never was an "investigation" case assignment. The emails from the "Investigators" clearly talk about a "case", but now they say there is " no case". There was a "case", but they did no investigation, even though they repeatedly told me they were investigating, so to cover up their misinformation to me and lack of progress, they claim "no case". The Jefferson County government refused to enforce THEIR laws and they have outright lied to me. Unbelievable.

I spoke with Investigator #1 today and filled him in on the situation. I told him about all the harassment, the attempted arson, the business cards and the threatening email and the harassment charge against the boy up the street. I gave him the case numbers I had, and later called with the last number for the email harassment. He says he will get the pictures to the lab.

Investigator #1 returned my call. Says the pictures are in the lab, which is backed up. He says he was unaware of the business cards fingerprints that needed to be done. I will call him back with the case number.

I called and sent Investigator #1 messages explaining the situation again, and asking why nothing is being done. He did call back. He was not happy that I said I felt nothing was being done. He says he has given his information to another officer who will be following up on the case. He wants the cdr and the messages and the video of the cdr placement today. I still don't think they are doing anything.

I received a call from the Jeffco Investigator #2. He asked me to stop investigating, that the police are on it. I asked what progress they have made and he would not tell me. I asked what timetable I can expect some progress to be made and he would not tell me. He suggested I talk to his supervisor.

I was told that the "anonymous" emails I'd received from Woody747 were awful, but not " criminally obscene" whatever the hell that is... Even Woody747 admitted they were obscene...
I was told the Jefferson County Sheriff's Department can't find out who was driving the E&M Disposal trash truck who stole my trash can. They will not prosecute the E&M Disposal Company, only the driver, and E&M Disposal will not tell them who the driver was (claiming bad record keeping).
Of course E&M Disposal will not reveal who the driver was, especially now that they know nothing will be done if they don't tell ... it might even be one of the owners driving that day. The company IS responsible for what their employees do, but not in Jefferson County Colorado. There are lots of "Get of Jail Free" cards laying around...
The Captain said they should have done a better job of keeping me informed of their progress on the trash can theft "investigation". I reminded him of their " punishment" of having a Jeffco Deputy stop by my house at 10am on December 25th, Christmas Morning to give me "status" That was clearly the Jefferson County Sheriff's Department " punishing" me for something ??? The Captain refused to acknowledge the " punishment". He said it was not " punishment" with a straight face... The message was "received".
Who are they to be punishing the citizens? Hell, they refuse to " punish" Woody747 for harassment, or the Mercers for noise violations or E&M Disposal for theft, but they find some way to punish me ??? I have clearly done something they disapprove of, when I ask what I did wrong, they deny it and the " punishment". Is this American Justice ???
Instead of being honest and doling out police protection and enforcement equally, they blame me and "punish" me (the victim) and play silly little word games. This is your County government folks....
I was told that all of this information has been given to the District Attorney's Office and THEY have said they have refused to prosecute.
Can you imagine the message that the Mercers and Woody747 and E&M Disposal have received by the Jefferson County Sheriff's Department? (I was right - see The Daily News for 05-21-2006)
That if "they" feel "wronged" (they were not wronged), then they get a green light from the police to engage in noise violations, harassment and theft, a Get-Out-Of-Jail Free card.
I guess that if I just quietly allowed (pun intended) the Mercers to abuse my airspace with illegal noise, then none of this would have happenned, so it must be all my fault that Woody747 harassed me and E&M Disposal has stolen my property.
So it seems like the Jeffco police think I have done "something", but they won't tell me what that "something" is. But because of that "something" they are turning their heads away from the noise abatement laws, the harassment laws and the theft laws. They are withholding police protection from me, and refusing to prosecute crimes against me. Crimes that Woody747 has admitted to under oath in court, theft crimes where I have a video of the actual crime, and the noise abatement laws where they don't even refute my noise measurements, they simply refuse to enforce them.
The Jeffco police have visited my home at 10am on Christmas morning to give me "status" of their theft investigation (there is nothing we can do, but we're doing all we can...).
I got the actual intended status message, I am being punished for "something", but they won't tell me what the "something" is.
Like they have somehow decided that the "something" they think I did, justifies the noise, harassment and theft against me. How do the perpetrators of these crimes know how far the Jeffco police has empowered them to go? It's not the role of the police department to allow crimes to occur based on their unhappiness with a citizen. In the final analysis, that's no better than a police department performing the harassment and theft themselves. Basically the Sheriff has accused me of putting a "kick me" sign on my back, so it must be my fault I was kicked.

We citizens pay dearly for our justice system, but it seems like we only get an organization that consumes our tax dollars and has an agenda of it's own, which does not include equal and fair law enforcement for all. In America I supposedly have the right to face my accusers. If the police think I have done something wrong, then they should have the integrity to tell me what that is to my face, instead of allowing (using) the other citizens to punish me (harassment, theft...) without penalty.
I have asked Sheriff Mink
times to meet to discuss the situation, all requests have been ignored. His Captain told me there are too many people in the county for the Sheriff to meet with all of them. Did they all ask for a meeting?
The Jefferson County Sheriff's Department and District Attorney scare me on many levels.

Why is the Jefferson County Sheriff Department and the District Attorney withholding police protection from me? I’ve heard "they" are "sore" at me for filing police reports they "don’t believe" and for "harassing" their Deputy’s. I’ve heard this from others, but they don’t tell this to me. All my police reports are 100% accurate and I challenge anyone to refute any of them. We were told on 02-01-2005 that there is no investigation of me. So if there is any disbelief about any of my crime reports, they are not letting me know about it.
Law enforcement agencies can abuse their power in many ways.
- Excessive enforcement.
- Selective enforcement.
Either way it gives law enforcement excessive and unreasonable power over the citizens. Today it’s noise abatement, harassment and theft selective enforcement on my behalf.
