One day I was visiting my construction site, looking out the back window of my spare room and Jeff was outside.  

We chitchatted a bit and then he nervously says to me "You're not going to like it, but we're putting in a swing set here", referring to its present location.   I agreed with him that I was not going to like it.

Think about it, on our 2nd, maybe 3rd time talking, he is already warning me about things they are going to do that I will not like. Oh yeah, he's a good neighbor ... the problem he predicted occurred - Surprise Surprise Surprise...

Jeff Mercer has even admitted that one of his daughters has a "screaming problem" on May 22nd, 2001 and confirmed it again on June 23rd, 2004 during our mediation sessions.

Some days later we were talking again and he asked me about my landscaping plans.   He asked me specifically if I planned on putting in any trees "for noise".

I told him I had no plans yet.   Things were still quite friendly at this time.   I of course didn't know the planned "swing-set" was a huge wooden structure with a platform that would tower over the future 6' privacy fence.

In 2000, after I moved in, and I objected to the playground noise and loss of my backyard privacy, Jeff Mercer will "warn" me again about their upcoming Character Assassination plans.

Before I moved in, and before they started their landscaping, Jeff was already worried about the noise the playground would create.

He was aware of the "screaming problem" one of his daughters had, but they put the playground just 8' from my home anyway, to hell with the neighbors - Right?
