In April of 2000 while I was having my landscaping done, the swing-set and platform structure appeared in a bed of pea gravel
This is the swing-set they warned me about a year earlier. They knew a year earlier the swing-set noise was going to be a problem for their neighbor, and they did it anyway, to get their playground " out of their way".
The noise from the entire playground was deafening. I couldn't even hold a phone conversation in my backyard.
Their high-pitched screams and squeals were ear-piercing, bone-jarring, blood-curdling and spine-tingling.
Jeff and Donna had a fencing contractor lined up quickly to get a fence installed. They were only willing to pay for a 5' fence, so I paid the extra for a 6' fence (Jeff had previously agreed to split the cost of at 6' fence).
Since I was paying the extra for the extra foot of fencing, it was decided that I would get the picket side of the fence facing towards my property. We also agreed that he would not allow his children to climb on the fence (another of his lies).

Even with a 6' privacy fence, the children had a clear view OVER THE FENCE into my yard from the swing-set platform, which was right up against our property line.

Immediately I knew there was going to be a problem with noise and privacy. His children would be playing in the playground and scream. They wouldn't even be saying words, they just screamed and shrieked. It was deafening. It seems the noise reflects and amplifies off the side of their two-story home directly into my home and back yard. It's been called an "acoustic alley".

Jeff Mercer as even admitted that one of his daughters has a " screaming problem" on May 22nd, 2001 and confirmed it again on June 23rd, 2004 during our mediation sessions.
The same noise from children in the street is barely noticeable, it dissipates. Between the houses, it amplifies and reflects into my home and back yard.

I had my landscaping contractor plant 7 aspen trees along the fence in a futile attempt to regain some of my privacy. Each tree was $135 installed for a total cost of $945.
The price was high, but I was desperate for privacy and I was unable to do that kind of work due to a wrist injury from a motorcycle accident.
I was lucky enough to find an air conditioning installer who was available to install central AC for $2000+.
All done in an expensive desperate (futile) attempt to try and regain some privacy and peace and quiet in my new home.
The trees have grown, but they do nothing to block noise. Their children and guests still have a clear view into my entire back yard from the slide platform. Hey Jeff, it's called a "privacy fence" for a reason!
