The agreement which the judge helped us work out on August 23rd didn't please the Mercers. They wanted to move the trampoline back to their side yard, 8' from my home since "it doesn't work in our back yard". The judge offered to rescind the playground court order if the Mercers dropped their restraining order against me.

The Mercers immediately said they'd drop it "for the sake of their children". They really meant they would drop it for THEIR sake.

Think about it, the Mercers have been crying and whining for months to ANYONE who would listen about how WORRIED they are that I may hurt their children.

• They tell this to our neighbors,
• They told this to the police,
• They told this to Channel 7 News.
• They swore it to the Jefferson County Courts to obtain a restraining order against me.

Then, when keeping the restraining order means they have to have the trampoline close to THEIR living area in THEIR back yard, they agree to drop the restraining order. As I've always said, the Mercers just want the playground equipment "out of their way".

The restraining order, and all their lies and accusations are their way of performing Character Assassination against me to avoid ever having to discuss the FACTS.

They claimed they were so concerned for their children's safety - they swore they were concerned for their children's safety, and in a flash they agree to drop it to get the trampoline tucked back neatly in their side yard, out of their way, where incidentally the children will be as close to me as possible, which they swore they were afraid of. Good Parents or Bad Lying Parents?

Jeff Mercer testified that he did not know the identity of anyone who has committed any harassment against me. He testified that he knows nothing about who has stolen my trash cans. He testified that he did not know who committed attempted arson against my house on May 31, 2004. He testified that he thinks others in the neighborhood know who committed the crime, but he does not know who it was. He was asked about every harassment event and theft event and he testified that he did not know who did any of it. (he also claimed he did not know what CDR was ???).

I attempted to have the restraining against the Mercers for my protection retained. For the longest time, I was unwilling to believe that the Mercers, or any adult for that matter could be involved in such hateful and hurtful and threatening harassment campaign against another human being.

But after I learned that a friend of the Mercers was involved in this activity, and that this friend said there was an agreement with the Mercers to do some or all of it, and considering the outright lies and Character Assassination by the Mercers, and how they have never honored their word that I saw, I changed my mind. I am very concerned for my physical and mental health from the Mercers and their Agents. Unfortunately, the existing restraining order against the Mercers didn't have the exact proper boxes checked and their activities against me were not covered by the existing restraining order. I may have to re-file the restraining order against the Mercers.

The Judge, using information he learned from our testimony in court and from a Jefferson County Police Officer who was assigned (at my request) to investigate the neighborhood dispute could find no evidence of any physical violence or any threats of any physical violence and dropped both restraining orders and dropped his court order requiring the Mercers to move the trampoline to their back yard, away from my property.

Now read what they swore to in court on 06/29/2004. See the words "IMMINENT DANGER". But when pressed by a Jefferson County Police Officer, they can't come up with one example (knowing he'd verify it) to validate what they swore to in court.

Jeff Mercer has admitted that one of his daughters has a "screaming problem" on May 22nd, 2001 and confirmed it again on June 23rd, 2004.

Now after all this, we are back to the same situation we were in when the Mercers broke their word and stopped honoring the signed mediated agreement in May of 2004.

Like I predicted last May, the Mercers (and their agents) have stolen the Summer of 2004 from me.

Sigh...

UPDATE: 10-23-2004:The Mercers put the trampoline back on the side of their house, which is just 8' from my home, I restored this website on Sunday 10-24-2003. For a while I thought the Mercers had the trampoline just back on the side of their house, without legs, but it's back in full screaming and shrieking use as I write this.
