On August 23rd, 2004, the Mercers and I attended a court hearing relating to the temporary restraining order they obtained against me in July.

After I testified, the Judge said that he was mis-informed about the prior (2001) signed mediated agreement, he had thought it required the children to be INSIDE at 7:00pm instead of just not using the playground equipment (8' from my house). He also said he was unaware that the prior agreement had [mostly] worked for the past three years.

This is typical. The Mercers have consistently mis-informed people and lied about the details of the first mediated agreement and about the whole dispute.

By lying to make the agreement appear to be significantly more restrictive that it was, and by performing Character Assassination against me for the last four years, the Mercers have managed to get some of the public on their side by inciting hatred towards me by using untrue emotionally hatred inciting words.

By keeping the discussion away from the real facts, and by keeping people angry towards me by lying and distorting the facts, they have managed to avoid ever having to explain why they are so selfish and unwilling to share the neighborhood with anyone.


Consider these other examples of the Mercers distortion of the facts to further their selfish cause.
  • At mediation on 8/4/2004, the mediator was also mis-informed by the Mercers about the first mediated agreement, he also thought the children were required to be INSIDE at 7:00pm.

  • The Mercers told this lie to the Channel 7 News reporter.

  • A Jeffco Sheriff Deputy, who was investigating, wrote more than once in his report incorrect information given to him by the Mercers.

    • Here the Mercers incorrectly describe our 2001 mediated agreement: "The result was an agreement that the Mercer children would come INSIDE at 1900 hrs. Monday - Saturday, and not play out back all day Sunday. They said that this agreement seemed to work for 3 years, but Larry bothered them when the children were not INSIDE right at 1900hrs. They said that Larry would call them and complain about it".

    • Here they outright lie to the Jeffco Police Officer: "They also told me that Larry yelled at their children from his yard when they were playing outside, especially if it was close to 1900 hrs".

    • The Mercers now lie to the Jeffco Police Officer about our 2nd Mediation attempt in 2004: "He said that Larry had demanded that the children either be brought INSIDE nightly at 1900 hrs, or their swing set be moved".
How many of our neighbors have Jeff and Donna Mercer told these and other lies to?

The Mercers work hard to keep people mis-informed through their lies and fear of the facts.

Jeff Mercer said they were embarrassed about the first rock throwing incident, but they don't believe it about the second incident, "there was video of the first" and you only have a picture of a rock on your window well of the second. I said I see how this works, I have cameras in place and was able to videotape the first rocking throwing incident, so you can't deny that. Then for you, I covered up the camera and was unable to get video of the second, so you refuse to acknowledge it happened. Then Donna said again it was "only pea gravel", and I replied it was rocks, Jeff says they don't have any rocks, only pea gravel. Either way, rocks or pea gravel, it's vandalism and it's wrong.

Jeff complained that I called when they were over the evening time by 5 or 10 minutes. I wanted to object, since I've never called at 5-10 minutes (but should have) and sometimes they were up to an hour late, then the judge jumped in and said that being late was wrong, just like they don't want me expecting them to quit early. Whew, he told them that cheating was wrong!

Jeff asked me if he thought I was more sensitive to child noise than average. I said I'm sure I am. And that is the purpose of the Colorado Noise Law, to eliminate personal opinions of what is too loud and what is not too loud. The law decides and I've measured it well over the legal limits, it's not too loud by my opinion, it's too loud based on a clearly well written Jefferson County Law -- which the Jefferson County Sheriff's Department refuses to enforce...

The Judge then got us to work something out.

The Mercers would move the trampoline to the west side of their property.

The Mercers would put up a cover on the slide platform watch tower to eliminate the view into my property. They would keep the children off the swing set and slide platform after 8pm (note it does not say INSIDE, just off the swing set and slide platform).

Donna said she "can't" tell her 2 year old he can't play on the swing. The judge said to her "Yes you can". "How do you tell him to stay away from the clothes washer". "You can control your children".

The Mercers would finally keep their children from climbing on the fence.

I would remove the www.feelmypain.net website or put up a page saying the issues were resolved. (The website was restored on 10-24-2004)

The Judge said he could not impose an agreement on us, but if we agreed, he could make it binding, a court order.

I neutered the website that evening. It took the Mercers 5 days to move the trampoline from the side of their house. They did not put it on the west side of their property as we verbally agreed to in court. They put it in the back yard, about as close to my property as possible.

They half-assed attempted to put up a slide platform cover which fell off and they NEVER got it installed. Typical.

The Mercers have never, ever honored any agreement they have made with me.

Look at the pictures, does this look like they have complied with the Jefferson County Court Order?

The noise from the trampoline inside my house was significantly reduced to the point where it was barely noticeable, and certainly not a problem. The noise from the trampoline in my back yard was reduced, but still annoying, and I believe would have still measured at illegal sound pressure levels. If the Mercers had put the trampoline on the west side of their property as we agreed to in court, I believe the noise levels in my back yard would have been much lower and acceptable and within the law.


At a court hearing on 9-23, before we could object, Jeff Mercer stood up and immediately started in with his Character Assassination routine against me.

He told the Judge lie after lie about me, I can't even remember them all.

He did say that I have called the police on FOUR of my neighbors. I'd like these FOUR neighbors to tell me who they are. I've called the police on the Mercers for excessive noise (since May) and on a neighborhood teenager (June) who sent me an email threatening to "mess up your house". FOUR times?

If as a teenager I had ever sent a message as vulgar and threatening as this teenager sent me, my father would have dragged me by the ear to the person's house and made me apologize. I have never heard from his parents. In fact, none of the parents whose children were involved in the stoning of my house have ever apologized either. Strange world we live in. The concept of personal responsibility is gone.

Jeff Mercer made a point about telling the Judge that the police were at my home again the day before (9-22-2004). He was trying to suggest that the police presence at my home implied something bad about my character. The police were at my home on 9-22. They were taking a theft report from me about my stolen trash cans.

Around this time, I was investigating all the harassment I've been receiving. We believed that most if not all was committed by "Woody747". After the Judge left the room, my attorney asked Jeff Mercer if he knew "Woody747" along with the fake attorney's that Woody747 has been impersonating. Jeff Mercer said over and over again that he did not know any of them, and then finally said he may "know" one of them. Jeff Mercer was not under oath at this time, however it was clear that he was nervous about the questions. Jeff started out lying and then finally admitted he knew "one" of them. I guess his final answer was the truth, there was only "one" person, Woody747 who was actually all of them. I now (10-26-2004) believe the Mercers were directly involved in orchestrating the theft of my trash cans. Simply Amazing... Create a reason for the police to be at my home and then attempt to use their presence against me in court. The Mercers were involved in the email harassment I've been receiving through their "friend" - Woody747.

Just how low will the Mercers go?

This is just typical of how the Mercers operate, they lie and embellish and lie and lie about me to the point where it's impossible to defend or even remember it all. But the general feeling is retained, so when he tells all these lies to all the neighbors since 2000, pretty soon people start believing it, without having ever seen any of what the Mercers have been spewing out against me since 2000.

It's called Character Assassination.


The Mercers seem like nice people when you meet them, but beware, don't ever disagree with them or expect them to share the neighborhood with you or expect them to honor an agreement or follow the law or live by their word.
